NEW RULES FOR 2024

The government has updated the migration laws to introduce a new visa called the Skills in Demand (SID) visa, which takes the place of the old Temporary Skill Shortage (TSS) visa starting December 7, 2024. Here’s what you need to know:

About the SID Visa

New Visa: The SID visa (subclass 482) is now in place of the TSS visa. All the rules that used to apply to the TSS visa now apply to the SID visa.

Three Streams:

Specialist Skills Stream: This is for people with high-paying jobs (at least $135,000 per year), but not for trades, machinery operators, or laborers. It’s designed to quickly bring in experts who can significantly boost Australia’s economy.

Core Skills Stream: For those earning at least $73,150 in jobs listed on the new Core Skills Occupation List (CSOL). Some jobs from the old TSS visa aren’t on this list, so check if your job qualifies.

Labor Agreement Stream: Continues the setup from the TSS visa, with more details to come on the Essential Skills stream.

Work Experience: You now only need one year of relevant work experience in the last five years, not two like before.

Income Thresholds: The salary limits for both Specialist and Core Skills streams will go up each year, starting July 1.

Visa Application Fees:

Primary applicant: $3,115

Additional adult: $3,115

Additional child under 18: $780

Changes for Permanent Residency

Path to PR: Everyone on an SID visa can now aim for permanent residency through the Employer Nomination Scheme (Sc 186).

Work Experience for PR: All your full-time work in Australia under sponsorship now counts towards getting PR, not just time with one employer.

Job Consistency: Your job for PR must match your last job under the SID, TSS, or 457 visa.

Salary for PR: The salary you need for PR is now linked to the SID visa’s salary thresholds.

Family in Applications: You don’t need to include family members in your nomination for them to get PR.

Sponsorship Rules

After Employment Ends: Once you stop working for your sponsor, they don’t have to make sure you’re still in that job, but you get 180 days to find a new sponsor or leave.

When These Changes Start

Effective Date: All these changes start on December 7, 2024.

Existing Applications: If you applied for a TSS visa before this date, your application will still follow the old rules.

Linking Old to New: If you have an approved TSS nomination without a visa application, you can use it for an SID visa until the nomination expires in 12 months.

New Rules for New Applications: All new applications for nominations or visas after December 7 will use these new rules.

These updates are designed to make it easier for skilled workers to come to Australia and stay long-term, addressing skill shortages and providing clearer paths to permanent residency.

For more detailed guidance, refer to the official home affairs website or consult with a migration lawyer or registered migration agent.

If you’re considering applying for a Temporary Graduate Visa, it’s important to be aware of these upcoming changes and factor the new VAC into your budget. If possible, lodging your application before 25 February 2025 may help you avoid the increased fees

New Ministerial Direction 111 Impacts Student Visa Applications

There have been recent changes to the way offshore Student (Subclass 500) visa applications are processed. Ministerial Direction 111 (MD 111) was introduced on 19 December 2024, replacing the previous Ministerial Direction 107.

Key Points of MD 111:

Applies to: Offshore Student visa applications lodged on or after 19 December 2024, as well as applications lodged before this date but not yet finalized.

Prioritization: Introduces a two-tiered system for processing applications: Higher Priority (Priority 1) and Standard Priority (Priority 2).

Higher Priority (Priority 1) Processing

Higher priority will be given to:

Students associated with education providers who have not yet reached their 2025 student intake cap.

Specific student categories:

School students

Non-award students (including short-term exchange students)

Standalone ELICOS students

TAFE students

Pilot Training Course students

Postgraduate research students

Foreign Affairs and Defence students

Commonwealth-sponsored students

Scholarship holders (meeting specific criteria)

Students from the Pacific and Timor-Leste

Students in Transnational Education arrangements

Subsequent entrants (dependent children under 18)

Standard Priority (Priority 2) Processing

Standard processing applies to:

Students associated with education providers who have reached their 2025 student intake cap.

Subsequent entrants (not meeting the dependent child criteria)

Any other offshore Student visa applications

What This Means for You

These changes may affect the processing time of your Student visa application. If you fall into one of the higher priority categories, your application may be processed faster. However, if you are in the standard priority category, your application may take longer to process.

Stay Informed

It’s important to stay up-to-date on any changes to visa regulations. You can find more information on the Department of Home Affairs website or consult with an immigration lawyer or a registered migration agent.

Welcome to Giri Law Insights! As a legal professional specializing in immigration and migration law, I’m thrilled to launch this platform to provide you with the latest updates, insights, and practical advice on navigating the complex immigration system in Australia. Whether you’re planning to move here or are already on your journey, this post will cover the most recent visa updates and explore the opportunities and challenges you might encounter as a newcomer to Australia.

Recent Visa Updates in Australia

The Australian immigration landscape is ever-evolving, with the government regularly updating visa regulations to address the country’s economic and social needs. Here are some key updates that could impact your immigration journey:

Skilled Migration Program Adjustments:

Australia’s Skilled Migration Program remains a popular pathway for qualified professionals. Recently, the government has introduced changes to the points system, giving higher priority to applicants with skills in sectors facing critical shortages, such as healthcare, IT, and engineering. Additionally, regional migration incentives have been strengthened, offering more points for those willing to settle in designated regional areas.

Temporary Graduate Visa (Subclass 485) Updates:

The Temporary Graduate Visa, which allows recent graduates to live, study, and work in Australia, has undergone several changes. However, the extensions that were offered during the COVID-19 pandemic are no longer applicable as of July 2024. Graduates should ensure they understand the current visa conditions and plan their post-study pathways accordingly.

Family Reunion and Partner Visa Processing:

The government has also made efforts to reduce the backlog in family reunion and partner visa applications. New processing measures aim to cut down wait times, making it easier for families to reunite in Australia. However, applicants should still be prepared for rigorous checks, especially concerning the genuineness of relationships.

Opportunities for Newcomers

Australia offers a wealth of opportunities for those who choose to call it home. Here are some of the key benefits newcomers can expect:

Robust Job Market:

Australia’s job market is resilient, with strong demand in sectors like healthcare, IT, engineering, and trades. For skilled migrants, this means ample opportunities to secure employment that matches their qualifications and experience. Regional areas, in particular, are keen on attracting skilled workers, offering additional incentives like regional visas and community support.

Quality of Life:

Australia consistently ranks high in global quality of life indices, thanks to its excellent healthcare system, world-class education, and stunning natural environment. Newcomers can expect a high standard of living, with access to top-notch public services and a safe, multicultural society.

Pathways to Permanent Residency:

Many temporary visa holders have the opportunity to transition to permanent residency, which opens the door to citizenship. The Australian government has clear pathways for skilled workers, international students, and family members, making it possible to build a long-term future in the country.

Challenges to Consider

While Australia offers many advantages, there are also challenges that newcomers may face. Being aware of these can help you better prepare for your journey:

Navigating the Visa Process:

The visa application process can be complex, with strict criteria and documentation requirements. Mistakes or missing information can lead to delays or even visa refusals. It’s crucial to stay informed about the latest requirements and seek professional advice if needed.

Cost of Living:

While Australia offers a high standard of living, it also comes with a high cost. Major cities like Sydney and Melbourne are known for their expensive housing markets and living expenses. Newcomers should budget carefully and consider regional areas, where the cost of living is generally lower.

Cultural Adjustment:

Moving to a new country involves adapting to a different culture, language, and social norms. This adjustment period can be challenging, especially for those with limited support networks. Engaging with local communities, participating in cultural activities, and accessing newcomer services can ease the transition.

Immigrating to Australia is a significant decision that comes with both exciting opportunities and potential challenges. Staying informed about visa updates, understanding the job market, and preparing for cultural adjustment are key steps to a successful transition. At Giri Law Insights, I’m committed to providing you with the latest information to help you navigate your immigration journey with confidence.

Temporary Graduate Visa Changes: As of July 2024, the extensions for the Temporary Graduate Visa (Subclass 485) that were available during the COVID-19 pandemic are no longer applicable. Graduates must now navigate the post-study visa options within the current framework.

4. Adelaide: The City of Churches

Why Choose Adelaide?

Affordable Education and Living Costs: Adelaide is one of the most affordable major cities in Australia for both tuition fees and living expenses. This makes it an attractive destination for students on a budget.

Quality Education: Adelaide is home to reputable institutions like the University of Adelaide, Flinders University, and the University of South Australia. These universities offer a wide range of courses and are known for their supportive learning environments.

Peaceful and Safe Environment: Adelaide is known for its peaceful, clean, and safe environment, making it a great place for students who prefer a quieter lifestyle. The city’s manageable size allows for easy navigation, and the community is welcoming to international students.

Festivals and Food: Despite its quieter reputation, Adelaide hosts numerous festivals, including the Adelaide Festival and Fringe Festival, which bring the city to life with art, music, and cultural performances. The city is also famous for its food and wine, particularly from the nearby Barossa Valley.

Considerations:

Adelaide is smaller and less bustling than cities like Sydney or Melbourne, which might be a downside for those seeking a more dynamic urban experience. However, the city’s affordability and quality of life make it a solid choice for many students.

5. Perth: The Gateway to Western Australia

Why Choose Perth?

Top-Quality Education: Perth is home to reputable universities such as the University of Western Australia (UWA) and Curtin University.
Beautiful Natural Surroundings: Perth’s location on the western coast of Australia means students have access to stunning beaches, parks, and outdoor activities. The city’s proximity to natural wonders like Rottnest Island and the Pinnacles makes it a great place for nature lovers.

Sunny Climate: Perth enjoys more sunny days per year than any other Australian capital city, making it perfect for outdoor enthusiasts. The warm, Mediterranean climate is ideal for enjoying the city’s beaches and outdoor lifestyle.

Growing Economy: Perth’s economy is driven by the mining and resources sectors, but it also has a growing technology and startup scene. This provides students with opportunities to gain experience in diverse industries and explore part-time work options.

Considerations:

Perth is geographically isolated from the rest of Australia’s major cities, which can make travel to other parts of the country more challenging and expensive. However, the city’s self-contained nature and opportunities for exploration within Western Australia make it an adventure in itself.

Choosing the right city for your studies in Australia is a significant decision that depends on your personal preferences, academic goals, and lifestyle. Whether you prefer the bustling metropolis of Sydney, the cultural vibrancy of Melbourne, the sunny lifestyle of Brisbane, the affordability of Adelaide, or the natural beauty of Perth, Australia offers something for everyone.

The Australian student visa process can seem complex, but with the right information and guidance, it’s manageable. This step-by-step guide will walk you through the process, from application to arrival, ensuring you’re well-prepared for your studies in Australia.

Step 1: Choose Your Course and Institution

Before applying for a student visa, you need to decide on a course and institution. Australia is home to a wide range of educational institutions, including universities, vocational education and training (VET) providers, and English language schools. Here’s what you need to do:

Research Courses: Start by researching courses that align with your academic and career goals. Consider the course content, duration, fees, and location of the institution.

Check CRICOS Registration: Ensure that the course and institution you choose are registered on the Commonwealth Register of Institutions and Courses for Overseas Students (CRICOS). This is a requirement for international students.

Receive an Offer Letter: Once you’ve chosen a course, apply to the institution. If accepted, you’ll receive an offer letter. You must accept this offer and meet any conditions outlined.

Step 2: Obtain a Confirmation of Enrolment (CoE)

To apply for an Australian student visa, you must have a Confirmation of Enrolment (CoE) from your chosen institution. The CoE is a document that verifies your enrolment in a registered course. Here’s how to get it:

Keep the CoE Safe: The CoE contains important information, such as the course start and end dates, and the tuition fees you’ve paid. You’ll need this document for your visa application.

Pay the Deposit: After accepting your offer, you may need to pay a deposit or part of the tuition fees. Once the payment is made, the institution will issue your CoE.

What is the Australian Skilled Visa?

The Australian Skilled Visa program is designed to attract highly skilled workers to Australia to fill labor shortages and contribute to the nation’s economic growth. This visa allows skilled workers to live and work in Australia permanently or temporarily, depending on the visa subclass. The most common visa subclasses under this program include:

Skilled Independent Visa (subclass 189): A points-tested visa for skilled workers who are not sponsored by an employer, state, or family member. It allows you to live and work anywhere in Australia permanently.

Skilled Nominated Visa (subclass 190): A points-tested visa for skilled workers who are nominated by an Australian state or territory government. This visa also grants permanent residency.

Skilled Work Regional (Provisional) Visa (subclass 491): A points-tested visa for skilled workers who are nominated by a state or territory government or sponsored by an eligible family member to live and work in regional Australia. This visa provides a pathway to permanent residency after meeting specific requirements.

Key Requirements for the Skilled Visa

To be eligible for the Australian Skilled Visa, applicants must meet several key requirements. Here’s what you need to know:

1. Occupation on the Skilled Occupation List (SOL) Your occupation must be listed on the Skilled Occupation List (SOL), which is regularly updated by the Australian government. The list includes occupations that are in demand across the country, ranging from engineering and IT to healthcare and trades. It’s important to check if your occupation is on the current list before applying.

2. Skills Assessment You must have your skills assessed by a relevant assessing authority for your nominated occupation. The skills assessment ensures that your qualifications and work experience meet Australian standards. Each occupation has a designated assessing authority, and the requirements may vary depending on the occupation.

3. Points Test The Skilled Visa is a points-tested visa, meaning you must score a minimum number of points to be eligible. Points are awarded based on factors such as age, English language proficiency, work experience, qualifications, and whether you have a state or family sponsorship. The minimum points required can vary, but generally, 65 points is the threshold.

4. English Language Proficiency You must demonstrate your English language proficiency by taking an approved English language test, such as IELTS, TOEFL, or PTE Academic. The required score varies depending on your occupation and visa subclass, but a higher score can boost your overall points.

5. Age Requirement To apply for a Skilled Visa, you must be under 45 years of age at the time of your invitation to apply. Age is a significant factor in the points test, with younger applicants typically scoring higher points.

The Application Process: Step by Step

Applying for an Australian Skilled Visa involves several steps, and it’s important to be thorough and organized throughout the process. Here’s a step-by-step guide:

Step 1: Check Your Eligibility

Before starting your application, ensure you meet all the eligibility criteria, including having an occupation on the SOL, meeting the points test threshold, and having a positive skills assessment.

Step 2: Submit an Expression of Interest (EOI)

If you meet the eligibility requirements, the next step is to submit an Expression of Interest (EOI) through SkillSelect, the Australian government’s online system for managing skilled visa applications. In your EOI, you’ll provide details about your skills, work experience, and other relevant information.

Step 3: Receive an Invitation to Apply

After submitting your EOI, you’ll be ranked based on your points score. If you have a competitive score and meet the criteria, you may receive an invitation to apply for the visa. Invitations are issued periodically, and the number of invitations depends on the current demand and the occupation ceilings set by the government.

Step 4: Lodge Your Visa Application

Once you receive an invitation to apply, you have 60 days to lodge your visa application. During this time, you’ll need to gather and submit all required documents, including your skills assessment, English language test results, police certificates, and medical examinations.

Step 5: Wait for a Decision

After submitting your application, you’ll need to wait for the Department of Home Affairs to process your visa. Processing times can vary depending on the visa subclass and the complexity of your case. It’s important to ensure all your documents are accurate and complete to avoid delays.

Step 6: Receive Your Visa

If your application is successful, you’ll receive your visa grant letter with details about your visa conditions, start date, and any other relevant information. Congratulations—you’re now on your way to living and working in Australia!

Benefits of the Australian Skilled Visa

The Australian Skilled Visa offers numerous benefits to successful applicants, making it an attractive option for skilled professionals worldwide:

Permanent Residency: Most skilled visas grant permanent residency, allowing you to live, work, and study in Australia indefinitely.

Work and Study Anywhere: With a Skilled Independent Visa (subclass 189), you’re free to work and study anywhere in Australia without any restrictions.

A Guide to Scholarships in Australia for International Students

Australia is renowned for its world-class education system, diverse culture, and breathtaking natural landscapes. For international students, the opportunity to study in Australia is a dream come true—but the cost of tuition, living expenses, and other fees can be a significant hurdle. Fortunately, Australia offers a wide range of scholarships designed to help talented students from around the globe achieve their academic goals. In this blog post, I’ll explore the various scholarship opportunities available in Australia, how to apply, and tips to increase your chances of success.

Why Scholarships Matter

Scholarships play a crucial role in making higher education accessible to students who may otherwise struggle to afford it. For international students, scholarships not only alleviate financial burdens but also recognize academic excellence, leadership potential, and community involvement. Receiving a scholarship can also enhance your resume, making you a more competitive candidate in the global job market.

Types of Scholarships Available in Australia

Australia offers a variety of scholarships for international students, funded by the Australian government, educational institutions, and private organizations. Here’s a look at some of the main types:

1. Australian Government Scholarships:

Australia Awards Scholarships:
These prestigious scholarships are offered by the Australian government to students from developing countries, particularly in the Indo-Pacific region. The scholarships cover tuition fees, a stipend for living costs, and allowances related to research expenses.

2. University-Specific Scholarships:

Many Australian universities offer their scholarships to attract top international students. Some of the most popular include:

University of Melbourne Scholarships:
The University of Melbourne offers a range of scholarships for international students, including the Melbourne International Undergraduate Scholarship and the Graduate Research Scholarships. These scholarships are awarded based on academic merit and cover tuition fees, living allowances, and relocation grants.

Australian National University (ANU) Scholarships:
ANU provides several scholarships for both undergraduate and postgraduate students. The ANU Chancellor’s International Scholarship, for instance, offers financial assistance to students from specific regions and covers a percentage of tuition fees.

These scholarships can cover full or partial tuition fees, living expenses, and other study-related costs.

3. Private and Non-Governmental Organization (NGO) Scholarships:

In addition to government and university scholarships, various private organizations and NGOs offer scholarships to international students. These scholarships may target specific fields of study, countries, or underrepresented groups. Examples include:

The Rotary Peace Fellowship:
Offered by Rotary International, this fellowship funds postgraduate studies in peace and conflict resolution at select universities, including those in Australia. It covers tuition, fees, and living expenses.

How to Apply for Scholarships in Australia

Applying for scholarships can be a competitive process, so it’s important to be thorough and strategic. Here are some steps to guide you:

1. Research Your Options: Start by identifying scholarships that align with your academic interests, field of study, and eligibility criteria. Visit the websites of Australian universities, government portals, and scholarship databases to gather information.

2. Prepare Your Application Materials: Most scholarship applications require you to submit academic transcripts, letters of recommendation, a personal statement or essay, and proof of English language proficiency (such as IELTS or TOEFL scores). Be sure to tailor your statement to highlight your achievements, goals, and how the scholarship will help you contribute to your community or field.

3. Meet the Deadlines: Scholarship deadlines vary depending on the provider and the academic calendar. Create a timeline to keep track of application deadlines and ensure you submit all required documents on time.

4. Focus on Your Strengths: Emphasize your academic achievements, leadership experience, and community involvement in your application. Scholarship committees are often looking for well-rounded candidates who demonstrate the potential to make a positive impact.

5. Seek Professional Advice: If you’re unsure about any part of the application process, consider seeking advice from an academic advisor, education consultant, or the scholarship provider itself. They can offer valuable insights and help you strengthen your application.
